Legal Question in Civil Rights Law in Michigan
Legal action against police officers
My wife was ticketed for turning on a red light on to a one way street. This is not a violation of Michigan traffic law. She went to court and the judge dismissed the ticket. What legal action is available to us against the police officer or city that he works for?

None, based upon your description of the event.

There is absolutely no legal action against the cop. You would have to show that the cop knew the law, knew that your wife did not violate the law and gave her the ticket for spite in order to inflict some emotional distress on her. If you talk to 10,000 laweyrs, you will get the identical opinion. Cops get away with a hell of a lot more than what your wife went through. William S. Stern
