Promisory Note

If I have a promisory note with my fiancee for money he owes me and he files bankruptcy, will the promisory note be null and void and I will receive zero dollars?

Re: Promisory Note

Probably not. If he lists you as one of his creditors, you'll receive a portion of any money left after the secured creditors have been satisfied - which in 99.99% of the cases is nothing.

If he doesn't list you, the debt is not discharged, but the probability of bankruptcy fraud is something that you should not wish to risk.

.... or you could just marry him and seek non-monetary retribution.
