Legal Question in Civil Rights Law in Michigan

Search & seizure

I ride a motorcyle with a video camera mounted on it to record my rides. If I got pulled over for some reason and the officer asked for the tape in my camera do I have to surrender it? thanks

No. But if he insists and you are forced to give it up, the cop can be sued under US law. Bill Stern 248-353-9400

Can you imagine a reasonable basis for his request, excluding pure inquisitiveness? I can't, and I don't imagine his superiors would either. Check it out.

Yes , you have to surrender it. This is something many people don't understand. If the officer tells you to surrender the tape - you surrender the tape no matter if he is lawfully entitled to seize it or not. The legalities can be sorted out later but, the important thing to remember is that at the time an officer gives you an order you must obey - unless the order puts you in personal danger.
