Sueing a School
My daughter was harassed, embarassed and her teacher used physical punishment because she lost her place in her science book. I was told by another attorney in Michigan that what this teacher done is considered corperal punishment.
I am going to the school board with this but in the mean time I had to pull my daughter out of the school and transfer her to a school I need to drive 20 miles to one way. I asked the school to put her in another 4th grade class because the thought of her going back into this class landed her at the doctors office and he said she was having asthma attacks that were related to stress. He put this in his records and said to pull her. I have.
I was wondering if I can sue the school for my gas, time and wear and tear on my vehicle. I pay taxes on 2 houses in this school district and can't even send my daughter to the school because of the harassment. Thank You for your time. Diana

The reason no lawyer answered your prior identical posting is "harassed, embarassed and her teacher used physical punishment" says nothing useful as they are not facts, but merely your conclusions (i.e. argument) predicated only upon your child's impresssions. You were not there. For example, what was the nature and severity of the physical punishment? Emotions are not facts.
If you made all these radical changes based soley on a single incident which apparently did not result in any discipline to the teacher, it's highly unlikely that you or your daughter would have a case.
