Legal Question in Civil Rights Law in Michigan

Was told a job was filled, when it wasn't.

I went to fill out a job application, and was told the job was filled after a call back to the manager telling her I was there. Then another person (of a different race) was told the job was not filled, and was given an application. She went in 2 days after me, because I told her about it. Is that a case of discrimination? I was not even allowed to finish filling out the application, the secretary took it back from me, after talking to her boss. The other girl WAS allowed to fill it out however. Also, I am over 40, and she was not. When I asked how it got filled while I was there, she said it ''probably'' got filled with a past application. Is this worth calling an attorney for, or not, since there was no ''injury''?

Yes. The employer will have to pay your attorneys fee so it is worth it to make the point. Sounds like a good case. Make sure that the other person who was allowed to submit the application will testify properly. Bill Stern 248-353-9400

There is most definitely an injury.

You need to file a complaint with the EEO on both race and age considerations. See if your friend who got the job will sign an affidavit (preferably in her own handwriting) stating that you told her about the job and that she went to apply for it AFTER you told her about it, and that her application was taken.

Do it today.
