Legal Question in Civil Rights Law in Michigan
Violation of Civil Rights?
Should my son (police officer) go to trial and defend his job or resign his job?
During an obstructions arrest he emptied the suspects pockets during the pat down. During this pat down, the suspect was making a scene drawing a drunken and excited crowd. In his judgement and concern the officer immediately secured the suspect in the vehicle and left, leaving the suspects contents, from his pockets, where they were (on the parking lot). Not much, phone, wallet, etc. Normal pocket fare.
Does this warrent a day in court or a counter suit for reverse descrimination?
He and the department are being charged with a civil rights violation!
Should he contact a lawyer outside of the ''Union Lawyer'' provided by the department?
When do the lines become clear as to what is more important, the safety of the officer and the suspect or should the suspects civil rights always trump?
Please hurry, they are about a week away from dismissing him or forcing him to resign.
Thank you!

Re: Violation of Civil Rights?
Ohh..., what you boys will tell your mothers. And, mom, I know you love your boy, but give me a break. You either put a lot in, or left a lot out of your post.
You child should know enough by now to solve this without his mommy's help and you are best advised (and probably told by him) to stay out of it!
But, in case he's as dumb as you say he is, HE SHOULD NEVER RESIGN UNLESS COMMANDED TO DO SO!
Got it?
Oh, and forget about the reverse discrimination.
