Legal Question in Technology Law in Michigan
My husband has been accused of posting an illegal ad on Craigslist in Michigan by his ex-wife. He has been contacted by a police officer that states that Craigslist has complied after 6 suphoenas...he is in the military and we are in New York. It has not gone to the Prosecuting Attorney yet and no one can give us any information other than it was an illegal ad... placed in the personals, someone called her cell phone and harrassed her. They replied to an e-mail in the Craigslist ad, that e-mail then gave them her phone number. Supposedly the deputy was able to obtain our IP address, my husband's logon, etc.
Our computer doesn't have a log-on. She is constantly trying to get my husband in trouble by making false allegations, the last one was when she called his Commander's and stated that he was going to abduct his own daughter while she was visiting her grandma in PA. Can they trace something like this? Could someone have hacked my computer (she is dating an absolute techno-geek)? Can they arrest him? What would the charges and penalties be? How could they prove any of it?

You are asking someone to have a crystal ball, to see into the future, and predict what can and will happen. This sounds like it could be serious, and what your husband should do is retain an attorney now while he is under investigation, so that if charges are pressed against him, he can immediately call his attorney. It is possible JAG (Judge Advocate General, military lawyers) would provide some help with this.
