Terms of Service Contract

Hey I had a two part question. First part of my question is can I take a preexisting sites user agreement and use it as my own changing only the names of the site? For example, I take albumbase[dot]com's user agreement (what i planned to do) and change absolutely nothing, just replace albumbase with my domain in the agreement. Legal or not?

Second question is how much does it approximately cost to get a terms of service made equivalent to the one on albumbase[dot]com? My site will be doing the exact same thing as albumbase, but only hosting one genre of music. I don't want to take chances with the music industry.

Yes, you can do it, but the danger is not doing it right and leaving residue of the site you took it from.

Your best bet is to take it as a sample to a lawyer and have her scour it to make sure that revisions work for you.
