Legal Question in Constitutional Law in Michigan

A family member of mine has a case pending further investigation in genesee county. The neighboring Lapeer county wants to charge him.Can they do this? He lives in genesee county. Lapeer raided the home last year and found very little drugs. Now they raided again and found a little pot and took all of the guns. They had no warrent and he does not even live in thier county. Is this legal?

Any challenge to the validity or existence of a warrant, search, etc., will be determined by the prosecutor's office and/or the judge if your friend is prosecuted. Lapeer must have had jurisdiction or a reason to search the house outside their jurisdiction. Your friend needs to retain a lawyer immediately if arrested and/or charged.
