Legal Question in Construction Law in Michigan

how to collect a judgement

The Michigan Dept. of Consumer & Industry Services ruled in our favor in a matter involving a contractor who failed to make repairs/restitution on a home addition project he did for us. According to the Final Order, the time has expired for him to make restitution and neither we nor the State have had a response from him. What are our next options? How do we go about collecting the money awarded us in the judgement? Do we need a lawyer or can we proceed ourselves? He currently has a property for sale - can we put a lien on it? Can we garnish his wages, if he is currently employed?

Thanks for your response.

Re: how to collect a judgement

I beleive that the only remedy the CIS has to to revoke the contractor's building license if he fails to make restitution. From that order you do not have a judgment and you cannot garnish wages or lien property, etc. What you need to do now is sue him in state court to obtain a money judgment.
