Legal Question in Construction Law in Michigan

Concrete Issues in New Home

What legal protection is provided in teh state of michigan on new construction homes relative to concrete work including slabs, driveways, egress and patio. Throughout our newly developed subdivision (3 years old or less), several properties are experiencing severe concrete cracks? Do we have any recourse?

Re: Concrete Issues in New Home

Your recourse would be against the contractor/company that performed the work. You'd have to look at your contracts regarding any warranty that may apply. If there is no warranty, you could file a suit, but would need an expert to opine on the shoddy work and agree that a 3 year old slab should not be cracking like at your property, that the cracking/damage is the contractor's fault (versus weather or misuse of the concrete, such as a vehicle that is too heavy, etc), and also opine on the cost for repairs or replacement.

Start by reviewing the contract with the concrete company, and then contacting them with your complaints, which I suggest you put in writing. The statute of limitations for a breach of contract case is 3 years, so I suggest you act quickly.
