cancelling CURVES contract
In Jan I joined CURVES, an international women's exercize chain. The contract I signed commited me to a startup membership fee and a 12 month membership at $34 per month. It stated that cancellation of the contract required a 30 day written notice..Period.. no fine print. Upon cancelling my membership I was made to sign a Curves ''cancellation policy'' explaining that I was to be charged $10 per month up to $50 for every month I did not continue my membership in addition to the remaining month's charge. When I questioned the manager as to why I was'nt informed of the ''cancelllation policy'' when I signed the contract I was told that CURVES int'nl does'nt allow their franchisers to put this info in writing when signing new members. I paid the $50, voiced my complaint and have since received a message from the manager that she will refund the money to me. My concern is that this is a fraudulent and illegal practice that this company has probably made lots of dough on and will continue to do with past and future consumers who just write the check without question. Is this legal and is there any way to make them disclose their ''cancellation policy'' BEFORE a membership contract is signed? Thanks

It is illegal and fraudulent to enforce a provision which was not disclosed.
A class action lawsuit is merited and would prevent such behavior.
