Legal Question in Consumer Law in Michigan
Cease and Desist
Can I send a cease and desist letter to a law firm acting as a collecting agent for an individual? They have a judgement from a couple of years ago. Do they have to send the records back to the individual?

Re: Cease and Desist
There is nothing wrong about a law firm trying to collect a debt. And you cannot interfere with their lawful attempt to collect a debt. If you feel your friend has a defense in the action, or the debt is unlawful, then have your friend execute a Power of Attorney so you can act on his behalf.

You can send it, but they don't necessarily have to accept it. You can't control whom the creditor chooses to represent them.
