Legal Question in Consumer Law in Michigan

Ebay Fraud

I live in MI. I bought an item on ebay (Hard Drive), sent a money order to Arizona to pay for the item. I received the item from a vendor in Il. charged to someone in MA. The vendor said it was a fraudulent order and wants me to send it back to them. What are my obligations as my money order has been cashed by the person in AZ.

Re: Ebay Fraud

The question: whose fault is it that you sent the check to the wrong individual? Did you send the money as per the Ebay instructions? And once you sent the money, is it true that you then received the merchandise?

I am uncertain as to the facts and circumstances, but if I were you, I would not send the item back as it would require me to pay for shipping and I would have no return on the money order. I would respectfully refuse and offer that should it come to light that the proofs support that I am responsible, I will do what is reasonable, but on the information provided, I am not comfortable that the request to return the merchandise may also be fraudulent. I would further request that all communications be in writing. Finally, I would notify Ebay of the situation.
