Legal Question in Consumer Law in Michigan
Mentally Handicap Minor Liable?
Hello, my brother is 17 and mentally handicapped in Michigan. He recently ran up over $4,500 in phone charges calling 900 numbers on my fathers phone. Can those charges be disputed due to his handicap? Is my father held liable?
Thank You! :)

Re: Mentally Handicap Minor Liable?
If I were your father, I would dispute the charges no matter what. Tell him to dispute the charges and to put all communications in writing. If he doesn't pay, even with a valid legal argument, the creditor can still provide a negative history on his credit report. Your father will be able to provide an explanation on his credit report as a temporary mitigation until he settles the matter. If he does dispute the debt in writing, he will have some leverage in negotiating the amount if he determines to ultimately pay something and he can also negotiate for a clean credit history.
If he would like my assistance in disputing the debt, he can feel free to contact me by any means. He can also read more on debtor/creditor relations on my free legal advice website at www.lawrefs.com.
