Legal Question in Consumer Law in Michigan
Propane tank fill up mistake.
My mother was out of town and ordered Fuel Oil while she was gone. They filled her up with propane instead. She did not order this. When she returned home she got an invoice for the neighbor who they were supposed to fill up with propane. Now they are trying to bill my mother. It has been over two weeks and now they want to come and take the propane back. She is afarid they will take more then they should from this very large tank she has. Is she legally obligated to give the fuel oil back?

Yes, she should allow them to take the Propane back or she will face the potential of a lawsuit. Typically, the law does not allow others to profit from reasonable mistakes.
