Retroactive maintenance fees for timeshare

I purchased a timeshare in Bahamas in 2006. I signed a contract allowing for max 3% increase in annual fees. There was no increase in 2007 or 2008 and those fees were paid in full, and timeshare weeks used. In 2009, I received a bill including a retroactive 3% increase for 2007, 2008 and 2009. Can a retroactive fee be charged when the previous bills ere paid in full at the time they were billed? The property is in Freeport, but the maintenance fee is billed from Michigan.

Would seem to me to likely depend upon what the contract says in regard to this particular issue (retroactive assessment of maintenance fees).

If it's clearly not addressed, then it's probably an illegitimate assessment(in my opinion).
