Return of Computer
An ex-employee took our ''old'' computer into a store and told them he needed the computer ''updated''. I was told by my husband(after it was taken in)it would cost about $300. My husband called the ex-employee(he was on vacation)and told him I was upset-I could have bought a ''new'' computer(with monitor etc)for that plus a little more. He told my husband they told him it was a whole new computer even better - they had ''upGRADED'' us. They charged us $422.00. We couldn't get on the internet,I called the store-took it(new)back-they fixed it. I asked where was my ''old one'' - they said ''probably in a landfill by now''. I asked why I wasn't given the ''old'' one back-they said they asked my(ex-empl.)if he wanted it-he said no-He denies this. They sent him back with an additional computer(to replace the one they ''tossed''). I had to take it(new)back AGAIN because it wouldn't come up-they said it was the ''cd'' hanging it up(come to find out they used my old CD)so I purchased a new one. I asked them what system was in the(old)one they said ''none''(no hard drive etc)so it's useless. The ''new'' one is still hanging up(even after the new CD)-they told me to bring it in again. Can I get my money back and my''old''one? It's less than 1 month old.

Depends on the store's return policy. The computer store can argue your employee had apparent authority to authorize them to upgrade the computer and dispose of the old one. Nevertheless, there should be some warranty. Probably the easiest thing to do is to get the store to replace the defective computer at no cost to you. If you are still not satisfied, you can sue the store in small claims court where parties represent themselves.
