Legal Question in Credit and Debt Law in Michigan
affidavit of non compliance
I was expected to pay a certain credit card company for past charges and if I did not pay an affidavit of non compliance was to be issued along with payment provisions set aside by the plaintiff. I lapsed on the payment and recently had the total amount due on the credit card taken out of a joint account without notice. Can they actually ''garnish my wages'' and take the money out even if I am unemployed and the money in the account was not mine but belonged to the other person on the account?

Re: affidavit of non compliance
They can garnish your wages only if you HAVE wages, and they can likely go into your bank account to collect funds as well. Of course, if you have no money and no income, you're fine for now. The problem is, when you get a job, you're fair game! You may wish to file for Chapter 7 bankrupcty.
