Legal Question in Credit and Debt Law in Michigan

auto charge off

my daughter got behind in her car payments and her car was written off as a bad debt. She wants to get plates for the car but is afraid the Michigan DMV will see the car as stolen. Do car companies notify the DMV if a car is considered a charge off?

Re: auto charge off

I don't exactly understand what you're asking me: does your daughter still have the car and the finance company merely charged off the loan obligation, or was the car repossessed? If the finance company wrote off the loan balance and your daughter still has title to the vehicle, then she will have no difficulty. However, if the finance company repossessed the vehicle, they will have to apply for what is called a repossession title on that vehicle, in which case it would make no sense for your daughter to register that car in her name because she no longer has interest in. If your daughter is trying to register a different car, whether she has had a previous repossession or a charge off on a different vehicle is irrelevant as far as the Secretary of State is concerned.
