Legal Question in Credit and Debt Law in Michigan
Bank Account Garnishment
I recently received court papers in the mail from my bank mentioning that a credit card company has filed a Writ of Garnishment (nonperiodic) against my account. I make just slightly more than minimal wage parttime and already have child support garnished from my check. Can they still take my bank account also? Will filing chapter 13 along with my other debts stop them from freezing my account?

Re: Bank Account Garnishment
Yes, they can take as much out of your bank account as they need to to satisfy the debt. If you file bankruptcy, then yes, that would stop the garnishment, and either wipe out the debt (if you did a Chapter 7), or alter/lower the debt and prevent garnishment if you did a Chapter 13. If you need to hire a bankruptcy lawyer, please contact me and I will refer you to an excellent lawyer.
You need to take immediate action - they can garnish anytime, and will keep garnishing until the debt is paid off.
Thanks.
