Legal Question in Credit and Debt Law in Michigan

Bankruptcy vs. Credit Cards

I have just received a summons. If I filed for bankruptcy would it stop the complaint? What about other credit card companies currently investigating my assests?

Re: Bankruptcy vs. Credit Cards

Filing of a bankruptcy petition would absolutely stop any collection activity, including a lawsuit proceeding, at least temporarily. Whether or not the cease of collection activity is permanent depends on the nature of the lawsuit. For instance, if you committed fraud, the debt would not be discharged. This however, is unusual in a debt collection lawsuit, and most likely, the lawsuit will be stopped permanently.
