Collection lawsuits
Two lawsuits were filed against my husband for two separate credit cards. He filed answers with the court and now one of them is willing to settle by entering into a consent judgement for a certain amount to be paid monthly. If my husband agrees to this, will he have to pay both at the same time if the other collection agency gets a judgement? Or will the other have to wait until this consent judgement is paid off? He would likely have to pay on both cards at the same time, but it depends on when each judgment requires him to start payments. I doubt a creditor would be willing to wait 6 months (for example) to have payments start, simply because he is paying on another card, but it couldn't hurt to ask. Just do not agree to a judgment that he cannot afford to pay and will be breaching its terms - then his wages will get garnished since there is already a judgment in place.
if he cannot pay on these cards and has other debts, he may wish to pursue bankruptcy.
