Legal Question in Credit and Debt Law in Michigan
Collections of an old credit card debt
I have been contacted by a collections agency requesting me to pay a debt for an old credit card.
What is the statue of limitiations in Michigan for this?
I even tried to call the original credit card company to talk to them and they would not help me. It shows as charged off on my credit report. I am not sure what to do about this, could you please offer some assistance?

Re: Collections of an old credit card debt
Six years for breach of contract.
It is normal protocol for you to be prevented from speaking with the original creditor as they have assigned the debt to another company and no longer have right to collect it. Indeed, you cannot pay the original creditor now and must deal with the agency.
You must make a deal with the collection agency to pay the amount owed or a reduced amount. Then, you must dispute the charge on your credit report proving that the debt was paid. In the meantime, you can provide an explanation on your credit report indicating your reason for not paying or that you did not pay because you validly disputed the debt.
