Legal Question in Credit and Debt Law in Michigan

Computer purchase loan agreement and balance due

I bought a computer through the employee computer purchase program, June 1999, through my previous employer. I was terminated in Feb 2000. At that time I tried finding out how to pay the balance, no one would answer me including Human Resources. I was told by other employees to wait for the bill(it never came). I received a letter on 3-17-03 asking for the balance.

What is the length of time they have to bill me?

Not to be flip, but they can bill you anytime.

I suppose the real question is "how long before they cannot bring an action in court to recover the money?"

The answer to that question is six (6) years. In this case, I would think that the six years would be measured from the date you received the computer, though the company would argue that the six years began when you last inquired about paying the debt - i.e. when you were discharged.

If you receive any papers from the employer or one of their attorneys that appear on a court document (summons & complaint) make sure you immediately see an attorney.

You may want to consider offering to return the computer in satisfaction of the obligation.
