Legal Question in Credit and Debt Law in Michigan
Credit Card Application
Many years ago my husband applied for a credit card. He never activated this card himself and has never used it and does not remember ever getting the card. This card was applied in his name only. I received the card and used it and signed his name to the charges (which he has recently found out about). He is now being sued for payment. Because he applied for this card, but as I said did not activate it or use it, he is liable??

Re: Credit Card Application
Your husband's defense, it sounds like, is that he is not responsible because he did not authorize use of the card (i.e., fraud). If that is the case, he may not be responsible, but you could be criminally liable.
On the other hand, if you used the card for household items, he may bear some responsibility. If you used the card for frivolous, personal luxuries, that tells a different story.
