Legal Question in Credit and Debt Law in Michigan

Credit Card Debt from Deceased Spouse

My dad recently passed away. Is my mother responsible for credit card debt that was in his name only? There was no life insurance and no money at all left to my mom when he died.

Re: Credit Card Debt from Deceased Spouse

Only the person availed credit is responsible for its repayment. In case his death, responsibility to repay relinquishes. Your mother may become responsible, if she inherents from his estate, and even then she will be responsible to the extent of whatever she will inherent not its beyond. This reply is based on law in Pakistan. I think it would be also applicable in India, too.

No for accounts or debts only in his name. If anything is joint, then yes, she is responsible for the debt. If you have problems with creditors sending letters or calling, send them a letter w/ a copy of his death certificate and they will go away.
