Legal Question in Credit and Debt Law in Michigan

Credit Card Debt from ex-spouse-spouse not knowing

I have read the Q @ A regarding credit card debt in the event of death of a spouse. What about credit card debt in the case of an ex. I recently find out my spouse has credit cards I had no knowledge of. The debt is substantial. We MAY get divorced in the future so debt has been attained while married-UNKNOWN to me. Debt is under his name only. Will I be responsible for half??

Probably not prvided your name is not on the accounts. But you should pull a 3 bureau credit report on yourself at either experian.com, transunion.com or equifax.com. Call me if you have additional quesitons. 586-992-9981

Normally you would need to prove that you were never on the account and had no access to the card as part of your argument that you should not be responsible for the debt. If your name was not on the account, you have a VERY strong argument, and technically, the credit card company cannot come after you, because they had no contract with you.
