Legal Question in Credit and Debt Law in Michigan

Credit card debt owed by a deceased person

A family member has passed away and owes money on credit cards. There is no will or estate since she has no assets other than one vehicle. The credit card companies have begun hounding for money. What are our rights, and what are we suppose to do?

Re: Credit card debt owed by a deceased person

If the decedent is the only person on the account, then you have no duty to pay the accounts. I would send a letter to each creditor who has been hounding you, along with a copy of the death certificate, and tell them to get lost. They of course will have to verify that the person is in fact deceased and left no assets, but that is their problem. The family does not have an obligation to pay the debts.

If you want someone to assist with this, let me know. Thanks.
