Legal Question in Credit and Debt Law in Michigan

Credit Card Summons

I was recently served a summons that I am being sued by my credit card company. I have not even seen bills from this company in about two years, when I had paid the card off. This is the first I have heard of this complaint against me. What sort of action should I take and whom should I call- the credit card company, the court, or the attorney for the company? The summons note also had 'second' written on it- I never received a first summons.

Re: Credit Card Summons

The credit card company probably had to get a second summons issued because it could not locate you to serve the first summons and complaint. Generally, a defendant will have 21 days after service of a complaint to file an answer. If he or she does not, the plaintiff can have default judgment entered against him/her for the amount stated in the complaint.

You should get your own attorney immediately to discuss how to proceed. Call me if you would like to discuss this in further detail.
