false credit report statement

I have a personal loan with Capital

One. In September I paid my bill 2

days after due date and included the

October payment as the payment

was rolled in by their web site. They

claim I never payed Oct payment and

have made a negative report to credit

reporting agencies. I have spoken to

their reps 7 times and they say they

will correct the information, I

originally spoke to them prior to the

30 day limit 11/10/08, payment due

the 17th. I have never been late

with my payments and pay more

than minimum. What recourse do I

have and are there legal actions that

I can pursue.

You need to dispute the the report in writing to the credit reporting agencies that this negative comment is on. Creditors don't tend to be proactive about this, so disputing with the credit reporting agency should help move things along. If it still doesn't get corrected, then you may want to consult with a local consumer law attorney about a Fair Credit Reporting Act claim.
