Legal Question in Credit and Debt Law in Michigan

Garnishment

A collection company garnished my State Tax return without giving me any notice. They claim I was served, but can not prove it. Neither can they produce any kind of a signed contract verifying the original debt. What are my rights?

Re: Garnishment

The company would have to have a valid judgment against you in order to garnish your tax return. It is unclear whether you claim the garnishment notice or the actual lawsuit service was not made. You might likely be time-barred as to contesting the case, if the service was good in the actual lawsuit. As for garnishment service the law allows for service by regular mail.
