Legal Question in Credit and Debt Law in Michigan
garnishment
How an I fight a wage garnishment ? It originates from a judgement against myself (and my mom as cosigner) regarding rent and so called damages. the exlandlord has has lawyer garnishing my mom, now i recieved garnishee disclosure & req. and writ for garnishment too. my mom expects me to pay her, which is fair, so I can't pay her and have wage garnished. How do I stop this? think lawyer would remove the garnishment on her and take only my money? I don't want to contact him til I have idea if my options.

Re: garnishment
I don't think the attorney will agree to just remove the garnishment on your mother. He wants his client to get paid as soon as possible, and that won't happen if only one of you is being garnished. It doesn't hurt to ask, but they aren't going to have much motivation to agree to it. There are certain exemptions to wages that you can claim that may reduce your garnishment, but there are strict guidelines in any event to how much can be garnished.
