Legal Question in Credit and Debt Law in Michigan

Identity theft

How do I find out about a credit card opened in my name? I'm being sued over a credit card I never owned? Where do I look to find the information? Can I look on the card website without re-activating the account?

Re: Identity theft

You need to send a letter to the company that is alleging you opened the card and ask for all information concerning the account, including the original application and contract. Also obtain copies of your credit reports from the 3 major credit reporting bureaus.

You need to respond to the lawsuit timely so they do not default you and are able to obtain a judgment. Any credit card company has the duty to prove that the account is yours and that the charges are accurate. Sometimes it takes them 1-2 months to get you the requested info, so you will have to be patient.
