Legal Question in Credit and Debt Law in Michigan
Lending money
My mother in-law is sueing us for 7,000 dollars because she gave us the money to buy our house. She told us it was a gift and now she wants us to pay her back so she is suing us. We had no written papers at all, it was word against word. My question is can she win?

Re: Lending money
Depends on who the court believes the most, how long it has been since she gave you the loan, what she told other family and/or friends about the loan. Why is she asking for it now? Is she mad at you, or has she fallen on hard times and is now changing her gift to a loan so she can get the money she needs???
Also, what is the history between you guys - has she given you money in the past, and then how was what treated? If it was always a loan, the court might believe her that this was also a loan.
Hard to tell. Sorry there is no straight answer.
