Legal Question in Credit and Debt Law in Michigan

Mortgage co-signer

I went through a divorce several years ago where the property was awarded to my ex. The mortgage does not show up on my credit report ( I was a co-signer on the original loan). However, the lender says I'm still listed as a co-signer and obligated for any payments. Do I still have any legal obligation on this debt if payments are not made?

Re: Mortgage co-signer

Yes. You still are legally obligated on the mortgage. You would however have a lawsuit against your ex for breaching the terms of your divorce agreement with regard to the mortgage. One recourse you have is to file a motion in circuit court re-opening the matter before the divorce court.
