Legal Question in Credit and Debt Law in Michigan
Mysterious Medical Bill in ''Collections'' after 2 yrs.
In 07/2003 my daughter was admitted to a hospital in Mich., and released the same day. I had received medical billing from this hospital, at which time I gave them my daughter's medical insurance information. In 07/2004 this claim was paid (I have proof) by the medical insurance. On Oct. 12 2005 I received a past due notice from a collection agency for 191.00. This was the first time I had heard of this ''bill''. I called the agency and they told me it was from the same hospital, and that's all they knew. I requested something to show me what this bill was for, and I was told (for a 2nd time) that all they could do was e-mail the hospital, and it was not their problem. Fine. Curiosity told me to check my credit report. Lo and behold the claim that was paid is listed on my credit report as a ''collection'', plus the ''open'' date was for 08/2004, AFTER the medical insurance paid! Of course, I'm questioning the validity of the 2nd supposed bill from the same collection agency. I do have both of these ''collections'' in dispute with the credit agencies reporting them. How am I to claim responsibility of an alleged bill without proof? What are my rights?

You need to set some time aside and start making telephone calls to the insurance company and to the creditor to straighten this matter out. The creditor would have to sue you or your daughter to collect the $191.00 and you would then have to prove that you either did not owe the money or paid the money you did owe.
