Legal Question in Credit and Debt Law in Michigan

non-payment, multiple jobs

One of my clients is a homebuilder,

web design most everything for

them from web to print to media

buying.

They have gotten behind in quite a

few invoices. They

are on hard times right now and we

are fighting with them to get the

outstanding invoices paid up. We've

managed to get half of what they

owe us (25k of 50k). We are

fortunate enough to have control of

their webstite and the threat of

them losing it is getting us that

headway. However, it's now coming

down to the client saying ''if i pay

$4k the website invoices will be paid

off, so can i have my website'' My

answer, no then i won't have any

leverage. I'm just not sure of the

legal ramifications of our method of

getting payment, especially if the

next payment is $4k or over... The

other issue is that their communities

are all seperate entities, as in

seperate LLC's with which they have

partner companies. Their other issue

is the partner co's aren't paying

them and they refuse to pay on their

behalf. My issue is, i did work for my

client directly, not with any of these

partner companies so doesn't this fall

on my clients shoulders to pay me?

and not divert it to the LLC's?

What does the contract for service say on these issues? With the amount of money at stake, you must have a contract.
