Legal Question in Credit and Debt Law in Michigan

Offer Settlement Payment

I was court ordered to pay my ex-husband a sum of money. I filed a motion for paymnt. through the courts and he denied it. I was wondering if there was a form that i could file to offer a lump sum settlement paymt. I have no lawyer rep. and am on my own. i am unsure what to do. Can you please help?

Re: Offer Settlement Payment

Are you talking about child support or another kind of debt? There is not really a form you could file in either situation if a judgment/order has already been entered, it is more a matter of negotiation between you and your ex. If you email me more information, I can provide you with a better explanation. Thanks.

Re: Offer Settlement Payment

Do you mean that you filed a motion for payment plan in a domestic relations case and the judge denied your motion? I advise you to seek legal counsel but if you want to do this on your own without an attorney, you could file a motion for reconsideration under Michigan Court Rule (MCR) 2.119(F), if it is not 14 days past the date of entry of the order. You could also propose an order including a request to stipulate to the court's entry of the proposed order under MCR 2.119(D) and serve it on your ex. A less formal method would be to draft up a document entitled something in the nature of Settlement Agreement and discuss it amicably with your ex-husband.

There are options but in any event, I suggest maintaining a positive and respectful relationship with your ex and if it is not this way, then start laying that foundation now so that he will work with you.
