Legal Question in Credit and Debt Law in Michigan

Overdue Hospital Bills

Is there a law about hospital bills being removed after so many years if they havn't been paid and if not, can I be taken to court for unpaid hospital bills?

Re: Overdue Hospital Bills

Actions on matters of contract must be brought in the court within six years of the last activity under that contract. That is to say, if you haven't paid anything for six years, and if you haven't admitted specifically to the debt for six years, they cannot prevail in a collection suit against you. You would assert the "statute of limitation" as an affirmative defense, and if you can prove no activity for six years, you are home free, as it were.

This rule applies to all payables, not only hospital bills.

Even if you are beyond the six years, the hospital can still attempt to collect, they just can't use the courts to do it.

Good luck,

Tom Weiss
