Legal Question in Credit and Debt Law in Michigan

Paid debt 4 years ago.

I refinanced in 2003. Paid off a credit card worth about 5600. A collection agency said I owed them 6000 3 years after paying for it. I was in the process of claiming bankrupsy so I just said screw it and put in on there. Now they are after my ex-husband. I tried to contact the refinance place but, they are no longer in business. I can't find the receipt from then and don't know what to do about it. How can I prove that I payed the bill?

If the account was joint with your ex-husband, then they can pursue your ex-husband for collection. Generally, however, they, however, cannot collect from your ex-husband if he was only an authorized user on the card.

You should get a copy of your credit report, and trace the reporting on that account. You can also contact the title company from your refinance transaction and find out if they paid off the credit card and have a cancelled check. You will need to do some leg work and creative thinking on this one if you want to prove that you paid the debt.

Alternatively, to prove that your husband was not a party to the original contract and therefore not liable for any related debt, you could call/write to the credit card company and ask for a copy of the original contract.
