Legal Question in Credit and Debt Law in Michigan

Responsible for deceased parents credit cards?

What do you do with deceased mother's credit card debts while in the process of probating will if I don't have cash flow to keep up payments until process completed? If you notify card companies of death, does account contiue accumulating interest and late fees?

Re: Responsible for deceased parents credit cards?

I'm sorry to hear of your loss. In regards to your question, the personal representative of an estate has several duties, one of which is to publish notice of the decedent's death and notify all known creditors. The creditors will file a claim with the court and are then paid through the assets of the estate. If the estate is supervised the personal representative must get permission from the court to make payments from the assets of the estate.

If you would like to discuss this in further detail or you need help probating your mother's estate, please feel free to call me at 586-992-9981.
