Legal Question in Credit and Debt Law in Michigan
Satisfaction of outstanding debt do to death
I just received a letter from an attorney trying to collect on a credit card debt that was just in my deceased wife's name and had no idea about. The attorney wants to know what my intentions are in satisfying this debt. Am I responsible for this debt if it was in her name only?

You are probably not responsible for the debts of your deceased wife, particularly if the estate is closed.

No, you are not responsible for the debts of another, particularly a deceased individual so long as the debt was not in your name or you did not guarantee payment of the debt. As to whether this creditor can recover from your wife's estate, that will depend on the stage of the probate proceeedings, if any. Should you have any questions, please contact me at www.lawgreg.com.
