Legal Question in Credit and Debt Law in Michigan
Shared Credit Card Debt
While my son was engaged he lived with his fiance for a couple years. During that type they took out 3 credit card only in my son's name. They ended up with $10,000 in credit card debt. They are now broken up. What rights or recourse does my son have relative to the $10,000 debt that is only in his name?

Re: Shared Credit Card Debt
Your son would have to sue his ex-girlfriend for any part of the debt that he felt she owed. If he can obtain a printout of everything purchased, he can assert that the items which were clearly for her, are her responsibility to pay for. Furthermore, he would do well to find witnesses who could testify that she was using the credit card as if it were her own and purchasing items for herself. It would be an uphill battle with the battleground in your local District Court.
