Legal Question in Credit and Debt Law in Michigan

statute of limitatiions

Please advise what the statute of limitations are for credit card debts. I have been a Michigan resident for six years plus, and before that a resident of California. The debts are in excess of eight years old, with no payment, agreements to pay, or written replies or acknowledgement of debt in that time. With most, we no longer receive any bills or invoices. With one, we have gone through about 15 collection aagencies, which threaten court action or contacting my employer. Thank you for your advice.

The statute of limitations in Michigan for open accounts, which would include a standard running credit card account, is six years. The period begins to run from the last item proved in the account. However, please note that most cardmember agreements specify the governing law (which state, plus federal) for the account and the agreement. You will have to consult your agreement documentation to determine the governing state law for your accounts. It very well may not be Michigan law.
