Legal Question in Credit and Debt Law in Michigan

being sued for a credit account

I am being sued for several thousand dollars and I absolutely have no recollection of ever opening this account. I think my Ex husband could have possibly opened the account. I don't know what to do I have been sent a court date. Do I need an attorney? I really have no idea. Can you please advise?

You need to contact the creditor or the creditor's attorney and ask them about the account. Document everything - name of person you speak with, time, and date. Ask you to send them the contract. If you have received the claim / complaint, you need to answer that denying that the debt is yours. In court, you need to argue that you never signed for the debt and it certainly isn't yours just because you were married to the debtor. Ask for the signature page to be presented. If you ex signed your name, then that is fraud and would not stand up. Bring your driver license so that you have proof of your signature.
