Legal Question in Credit and Debt Law in Michigan

getting sued by credit card co.

I received a certified letter that I am being sued by a credit card co. I have in the past couple of months paid over double of my credit limit and still have a balance of almost $1000.00 due to fees. When this overdraft account was opened about 6 years ago I received the credit and then received a letter denying me, but they could not take it away because I had the credit for over 30 days. Is it possible that since I was never to receive the credit and have paid back over double what I borrowed that the collection agency would write off the rest. If not what do I have to do to respond to the court papers?

Hmmm. If you have been paying, then they should not be suing you. Something fishy going on here, but I would suggest immediately filing a response to the lawsuit requesting more time to answer (so they don't default you), and consulting a lawyer ASAP. You may have some legal defenses to payment (such as usury) that only a lawyer with intimate knowledge can explore. That person also might be able to settle teh case for you at a significantly reduced amount.
