summons for collection
I just received a summons from my mother to collect opn a debt that she alleges I owe her. I owe her nothing and have signed nothing from her, unless she has forged documents. I need to know how to respond to the summons and how to proceed form that point. She is unstable and had frraudulently obtained legal services through the UAW under my las name which is different than hers (the services are part of my late father's benefits). I cannot afford an attorney, nor can I settle with her. She has called once a day for a month and I have spoken with ehr numerous times. When she finally admitted that she was suing me she told me that she wants to settle, but not for money. She will not converse more but says that we never have enough time to tak. Like I said, she is mentally unstable and on multiple prescriptions as well as recreational drugs. Please help me. I was living a nightmare with her for 23 years, paying her bills etc. and I just want a chance at my own life now. Any suggestions will be greatly appreciated. I live in Southgate MI. If you cannot afford an attorney, you may qualify for free legal services - contact the State Bar of Michigan's attorney referral hotline for further information and telephone numbers.
Definitely respond to the lawsuit timely, otherwise she may win by default, simply because you didn't respond.
If there is nothing in writing, then it is her word against yours. If the case is in small claims court (for claims under $3,000), then you cannot have a lawyer represent you, however, you can still get legal advice to assist you with paperwork or knowing how to argue and present you case in court.
It sounds like she doesn't have much of a case, but you never know what she might pull out of the air.
Respond to the lawsuit and I would also draft a letter to her indicating that you will be seeking sanctions (costs) against her should you win, since her lawsuit is frivolous. Then maybe she will dismiss the lawsuit and stop wasting your time.
