Legal Question in Credit and Debt Law in Michigan

Summons

An officer of the court was here about 3 weeks to serve my husband with some papers. He said he could not leave them because they were for him only. My husband is out of the country at this time. My husband phoned the officer and ask him if he could leave them with me and he said no. My husband is very worried because if he has to answer a summons and a court date he doesn't want to miss it. We live in the county of wayne in the state of Michigan and the summons is from the county of Bay city, Michigan. I believe the papers are for a credit card that we owe. I called the Bay city court and explained the situation to the court clerk and she told me that the court not take any legal action against my husband until he was served the papers. What I need to know is if this is correct. my husband was supposed to be back on 12/17/2005. but he says that it looks like he want make it home until the first of of 01/2006 We owe them around $4200.00 and offered to give them $1200.00 in March of this year and for hundred dollars a month until it was paid off. Again I ask you can any legal action be taken against my husband if he doesn't receive the court papers?

Re: Summons

Your husband is not required to do anything until he is served. The Plaintiff make seek an order for alternate service (regular mail or posting on your door). If your husband is out of the country, he can either hire an attorney to take care of the answer or answer it by mail from whereever he is.
