Legal Question in Credit and Debt Law in Michigan
taking down some trees
My husband and I hired a company to remove 1 big tree and 2 smaller trees for one price. The company removed the 2 smaller trees but refused to remove the big tree citing it was underestimated. Are we bound to pay the new fee of $500 he wants to charge even if we did not agree to the new price and the job was not finished? He had an attorney send a letter stating he is collecting the debt and that I am trying to get something for nothing and he will get pleasure out of suing me, therefore teaching me a lesson I richly deserve, as the attorney stated. Could this letter constitute liable or defamation of charater?

Re: taking down some trees
It would depend if the company looked at the trees BEFORE giving you the price, or just relied on your description of their size. Assuming the company came out, looked at the trees, and said it will cost X amount, they should be bound by their original quote.
If he is trying to modify the agreement, and you do not want to accept the modification, you do not have to. You may wish to hire a lawyer to resolve the dispute - it sounds like the company you hired is jerking you around.
The letter is not defamation - there is nothing defamatory in it from what you have said and the letter was only sent to you.
